OK – I am going to be unavailable this whole weekend (three day weekend) so I am going to write up my thoughts and hopefully answer most questions. I will not be able to answer questions until Tuesday.
So what now for DV 2020 selectees.
OK – there are FIVE groups:
- People that had been issued visas but those visas expired.
- People on AP since having interviews earlier this year
- People who had interviews scheduled by KCC, but the interviews were cancelled
- People who got the ready for scheduling email.
- People that did not get the ready for scheduling email.
Group 1. You can get your visa re-issued, even if you are in the Schengen area. Contact your embassy and quote the judges order. You probably will need a new medical and will need to pay fees again. Don’t delay – you need to act fast. You should not need an interview so this should be easy for the embassy.
Group 2. If your case is now resolved (meaning whatever caused the AP delay is resolved) your case can now be approved. You will probably need a new medical to ensure the maximum visa validity. Contact the embassy asap and discuss the case with them. Do not waste time – now is the time to fight for your chance.
Group 3. Contact the embassy and see if they will schedule your case as an “emergency” or “mission critical” appointment. That is what Judge Mehta has ordered. You should make sure your medical is new.
Group 4. Having slept on this it strikes me there may be a chance for you. If you are in a country where the embassy is open and there are not that many winners there, I suggest you contact KCC and respectfully ask/demand that they forward your case to the embassy. This is outside of their normal procedure of scheduling, and they may not be able to do it – but if they will just send the case to the embassy, then it will be up to the embassy and yourself to get things arranged for the interview and the medical. It’s a chance. Quote the part of the order that I have quoted below. Judge Mehta has noted they behaved wrong and now need to do whatever they can to fix the problem in the last few weeks. Write to KCC and refer to the judges order – maybe some of you can make this happen.
Group 5. Other than cases where you are named, your chances of interview before the September 30th deadline is low. If there is an extension granted, it may only be covering the plaintiffs named on the various lawsuits. However, we will need to wait and see what Judge Mehta decides on the 25th.
In each case you should be prepared to refer to the lawsuit, and if needed provided a link to the order if an embassy does not know about it yet. The link is HERE
For those of you contacting the embassy or KCC, quote this part of the order that says they need to use “undertake good-faith efforts,” to “expeditiously process and adjudicate” your case by September 30th.
When contacting the embassies or KCC, you could use the following beginning of a letter with extracts from the court order.
Dear Sir/Madam,
As you should be aware on Friday September 4, Judge Mehta issued an order to the Department of State which directs the agencies such as DoS, KCC and the embassies to process and adjudicate DV2020 cases by the September 30th deadline. Judge Mehta has asked for a report of progress (including actions taken or not taken) for review on September 25th.
Additionally Judge Mehta found the following:
(1) the State Department’s policy of not reviewing and adjudicating non-exempt visas
is not in accordance with law, is in excess of statutory authority, and is arbitrary and capricious;
(2) the State Department’s non-processing of 2020 diversity visa applications constitutes agency
action unreasonably delayed; and (3) the State Department’s exclusion of 2020 diversity visa
applications from its guidance on mission critical services is arbitrary and capricious.He then ordered:
“Defendants shall undertake good-faith efforts, directly and through their designees, to expeditiously process and adjudicate DV-2020 diversity visa and derivative beneficiary applications and issue or reissue diversity and derivative beneficiary visas to eligible applicants by September 30, 2020”
Given this judgement from the Federal court, which has jurisdiction in these matters, I am contacting you to request your immediate cooperation so that my case can be adjudicated by the deadline and according to the order of the judge.
Suggested format for an email – add your own particular details and request according to your scenario (group) ALSO Include the link to the order.
For people named on the various lawsuits, contact your lawyers for more information – but you must realize they will be very busy so be patient. Those people should find their cases are rushed through whatever stage they are at, but again – your lawyer can advise.
About entry to the USA. The judges order explains that people will be subject to a ban on entry until January – so you could have the visa issued in September but could not travel until January. That is why you need a new medical to ensure the longest possible validity. HOWEVER, DoS might implement that differently because normally a valid visa means entry is allowed – so we will see if they choose to annotate these visas in a special way to control the entry period.
About closed embassies. For groups 1 and 2 no interview is needed. But for group 3, interviews should be possible even if the embassy is not fully open. Push the embassy for a mission critical/emergency interview as ordered by Judge Mehta.
For DV2021 cases
This MAY mean we can see some interviews scheduled in November and December. However, that is not 100% certain so wait and see. Having said that – we still have 9 months after December – so relax. Obviously DV2020 cases are the bigger concern right now because they have so little time. So please – hold your questions.

The chart stops at cases 9001 and above.
Nothing shows after that. Why is that? How can I know the numbers before my case number?

Here is my input:
I reside in Iraq, I am in Group 3, NOT on the plaintiff list)and I was scheduled for DV2020 interview on April 29,202 in Abu Dhabi (United Arab Emirates)
My interview was cancelled in March due to the pandemic .
Contacted (Sending one Email only) the US embassy in Abu Dhabi (as instructed by this article) on September 6th, 2020
Received the automated Email confirming receiving my Email.
September 13, 2020 I received an Email to appear for interview On 17th of September.
Of course very challenging to travel from Iraq to UAE within few days in this pandemic era.
Few challenges I do have:
Renewing the police certificate (which may take at least 2 weeks)
Securing a medical appointment at Abu Dhabi (I am about to call them right now)
I will take the chance even without the renewal of police certificate and go the embassy and do whatever I can.
It is a one time opportunity and I will do everything possible In my hand.
I just wanted to share this with you all.

No direct flight to Abu Dhabi so I booked Dubai then to Abu Dhabi, however, they told me you will be quarantine for 14 days at the hotel.
I’m trying to call the Abu Dhabi and transfer the case to Dubai consulate instead since it will serve no purpose of staying until 30 of September at the Hotel in Abu Dhabi.
Will see what will happen!

Yas, the most important thing is go to the interview by any means. They can put you on AP until you bring the medical which might take few days and then they will stamp your visa. Don’t miss the interview by any means. Good luck

Simon, you are right, it used to be 1 year. Iraq now issue police certificate for 3 months only so I will take the old one, apply for new one and see.
Baker, on point, exactly that is what I thought. I was able to secure an appointment on Tuesday evening and hopefully I will be there by that time. I was never put in such tied timeframe in the past. But here we are, welcome to real world of every single minute counts.

Yas, Inshaallah all will be well. As Simon advised, make sure to have DS-5540 & I-134 forms ready with you just in case. Make sure to take all the originals of the documents you submitted to KCC and the additional documents and 2 photos as listed in the check list of US Embassy in Baghdad. Make sure to review and remember all the details in DS-260 visa form as they will ask you many details from the form in the interview.
Try to stay in a hotel very close to embassy in Abu Dhabi to avoid any traffic jam or surprises in the morning. Make sure that your flight is to Abu Dhabi as there is lots of restrictions to travel from Dubai to AD.

Correct, US Embassy accepted the police certificate (even it is written on the certificate that it is valid for 3 months). No need to spend time, effort and money on new police cert. if the old one date is less than one year.

So I wanted to update you on two critical points you should be aware of if your interview at the US Embassy in Abu Dhabi (from my own experience):
One:
Get form DS-5535-Supplemental-Questions filled out and ready (at least in my case, the took the passport and put me on AD and Email me the form to be filled out and sent back to them.
Second:
As of Sep 17, 2020 the United Arab Emirates does have restrictions in place for people moving from Dubai to Abu Dhabi. Unless you know the area really will to bypass legally (luckily) the Government Ministry of health checkpoint at the borders between Dubai and Abu Dhabi, you will be waiting hours before your turn to wear the tracking bracelet. And as a result, you have to be quarantine for 14 days at the destination you are heading to! Breaking the self quarantine without Ministry of Health permission (Phone number can be acquired by asking anyone in UAE) will face a fine of (about 16K US dollar)
FYI, The medical appointment can be done easily in Dubai if you prefer to even if you already scheduled your in Abu Dhabi and missed it due to being late.
I filled out the form and now pending their decision. Just in case you don’t know, this form is a result of Trump administration and utilized to provide all US intel. entities further information to do background check.

Just got off the phone with the Consulate in Auckland, New Zealand:
It sounds like they’ve just received clear information and steps regarding what to do with diversity visas.
1) They said they are going to send out emails in the next few days to confirm if applicants still want to continue with their applications.
2) For those that do, they said they are planning to arrange all of the previously cancelled interviews and reschedule them for the same day on the 24th of Sept.
Seems like they are doing all they can to help groups 1, 2, and 3. Not so sure about 4 and 5 yet.

Forgot to mention – I’m not a plaintiff and I am from Schengen area.
Yesterday I contacted my embassy and they said they are ready to schedule me as soon as KCC forwards the case to them as my embassy is not that busy with DV cases.
Today I called KCC again. Had to wait almost 10 minutes to be connected with the operator. The attitude was very different. They didn’t even ask for my case details to identify me.
I told that my embassy would be ready to schedule me for the interview if they would send the documents promptly and that this embassy is not that busy trying to refer to section 4 from the DoS guideline prioritization plan. They said doesn’t matter that my embassy is not busy, because they (KCC) are busy. Busy with processing plaintiffs.
So what they said was – plaintiffs first, then everyone else in numerical order of the case.

these questions are regarding a potential transfer of cases/interviews to one of three alternative consulates to be named by plaintiffs.
1) For those of us within the restricted travel regions (UK, Ireland, Schengen-EU, China, Iran, Brazil), is it correct that we would have to list three consulates OUTSIDE of these regions, schedule an interview there once KCC is ready, and travel there 14 days prior to the interview to basically quarantine until the day of the interview?
2) If the case is granted and a travel visa is issued at the interview, is it necessary to travel to the US straight away? Because going back to our restricted home regions would invalidate the travel visa, correct!?
3) Could the travel visa be re-validated if at a later time we again spend 14 days in the same segway country before flying to the US, or would that require a whole new travel visa? The latter would be a risky process.
4) If we travel to the US directly from the interview, do you have any idea how long we might have to wait at the recipient address for the final greencard? Does it take them days/weeks/months to send the papers in normal years?
Any clarification or better understanding would be appreciated!

1. No you would need to move the interview to another country (that is what the email is asking for – three choices), but you would not technically need to quarantine before the interview to my understanding (but you would have to perform the medical there anyway so you will need some time in country anyway – so if you can do the 14 days that is better. Then you would need to enter the USA after the Dec 31st and having been outside the Schengen area for 14 days again – unless that is lifted in the meantime. Clear?

I contacted the US Embassy in London and they responded with the following:

The U.S. Embassy in London has not yet resumed D-V visa services. We are only currently processing visas for spouses and minor children of U.S. citizens (IR-1, CR-1, IR-2 or CR-2). Therefore we are unable to proceed with Diversity visa applications or reissuances. We are taking the issue of Diversity visas seriously and we will resume routine visa services as soon as possible but are unable to provide a specific date at this time.
Please keep checking our website regularly as that is where we will share updated information about Presidential Proclamations, travel and visa services as soon as it is available. We are unable to predict when standard services will resume, but please be assured that we will update the website when there is any news.”
I have pushed them stating that DV2020 winners can be mission critical going by Judge Mehta’s orders, however no response.
Does anyone else have similar experiences or idea on how to approach this?

DoS have released a statement on how the order is to be implemented, including London should get the message over the next few hours and will soon adjust their responses. However, the UK/Schengen ban is still in force so unless that can be cleared out people affected by the regional restrictions will still not be issued visas. See my update here:

I wanted to share this new development, which unfortunately looks like bad news for many of us.
According to the government, the regional-focused Presidential Proclamations related to COVID-19 (PP. 9984, 9992, 9993, 9996 and 10041) remain in effect and are not subject to the court’s order. As a result, DV applicants who have been physically present in an affected region during the preceding 14-day period will not be issued an immigrant visa unless excepted under the relevant proclamation or until they have been outside the affected region for 14 days…
If I’m not mistaken, it’s no entry = no visa all over again. That means that all DV-winners in the Schengen Area and UK are going to lose their chance of getting a visa unless they transfer their case to a country not affected by the proclamations, then quarantine themselves for 14 days, and finally have an interview – all until the end of September, in the midst of the pandemic.

It seems answers vary, I sent two emails two days ago, one to KCC and another to the Embassy.
The Embassy (Qatar) replied they’re currently reviewing DV cases and will notify me with updates but unable to do so because they’re waiting for the Consular Affairs guidance.
I called KCC, the guy didn’t seem to care less about the situation, I asked him to send my case the Embassy, he said due to COVID bla bla bla, I asked if he was aware of the court order, he said yes but we’re not processing yet, I pressed further asking him to move my case since it’s not harming anybody, I am losing time for no apparent reason, he said we have no instructions from State Department, I said I’ll call back in two days to check again.
They however have not answered my email, yet.

I contacted both KCC and our embassy today. The lady from KCC said that they don’t schedule any DV 2020 cases. They are waiting for further information from other department and I should call them again on Friday. The lady from our embassy said that she’s aware of the order and as soon as the get the green light, she will be able to set an appointment as a mission critical. I have to call them tomorrow to get to know what we should do next. It seems that we still have a chance. I’m in group 4 btw.

Keep in mind that the decision was issued Friday evening of a three day US Holiday weekend. It is doubtful that
@StateDept
actually issued any guidance over the long weekend, such that most consulates replied to emails with its standard denials. Email AGAIN now.
I plead with us to also search for information, not just sitting and waiting for everything to be chewed and put in our mouth, in this case I think it would motivate Mr Brits and safe time as well. My perspective. I’m sorry if I may offend someone here.

I am group 3 (EU) but not a named plaintiff. I emailed the US Embassy in London and they didn’t seem to be in a hurry to process DV visas before the deadline. This was their reply:
“Thank you for your email.
The U.S. Embassy in London has not yet resumed DV visa services. We are currently processing visas for spouses and minor children of U.S. citizens (IR-1, CR-1, IR-2 or CR-2). Therefore we are unable to proceed with processing Diversity Visas.
Please keep checking our website regularly as that is where we will share updated information about Presidential Proclamation, travel and visa services as soon as it is available. We are unable to predict when standard services will resume, but please be assured that we will update the website when there is any news”
Clearly, every day that passes without DV cases processed is visas lost. I was wondering if this response could be useful at the 25 September hearing to support the argument for a potential deadline extension and to show that the state didn’t take immediate action despite Judge Mehta’s ruling?

The response means they are only doing mission critical cases. You need to contact them again explaining that the judges order means they should handle DV as a mission critical. Fight and document what you did.

I have a question please.
I am group one cases.
I am from Iraq the USA consulate in Baghdad is closed from January, thus the immigrant visa will process in the embassies of Ankara, Doha and Abu Dhabi for iraqi people. I contacted all of them but there is no response from them. I do not know how should I start and where should I send my documents.
Please do I need to resubmit my ds260 with updates to one of these embassies? Additionally, can I apply with out medical exam because IOM centers in Iraq are closed?
Please I am really in need to get your advice because I have very limited time.

We have also received an email from the law firm confirming that we can contact the embassy but the embassy seem to have no guidance received. So I just got bad news for me
I sent an e-mail to the embassy in my country 2 days ago asking for re-scheduling my DV Visa appointment that got cancelled in March, and I just got the reply today, they said they are not able to schedule the appointment for DV applicants.
I also contacted the hospital to schedule my medical check up appointment, but they said they are currently not able to schedule medical check up for immigrant visa.
Any solution?

I am DV winner of 2020 from nepal and my case number was current for june.i am in group 4 and I have received message from kcc says congratulations your case number is ready for interview on November 2020. But I did not get 2nd letter and after ruled by court i have send a mail to kcc saying that please grant me 2nd letter for further processing but i forgot to attached court order. Now i have to send again or leave as it is.it is possible for getting second letter before September 30.

I am in group 3 category who’s visa interview was cancelled. As suggest, I wrote and email to Embassy mentioning judge Mehta’s verdict and asking to reschedule my interview under “mission critical” case. This is the reply I got from them today;

In response to your question, we would like to inform you that as of March 17, 2020, the United States Embassy in Kathmandu is cancelling routine Diversity visas and nonimmigrant visa appointments. From March 23, 2020, the U.S. Embassy is cancelling all routine immigrant visa appointments. We will resume routine visa services as soon as possible but are unable to provide a specific date at this time.

Guys, every single negative answer you receive from embassy/consulate/KCC must be forwarded to Attorney Philip Kuck, even if you were not a named plaintiff, so they (with other attorneys) can use these reply as proof of bad faith and no effort.

As always thank you so much for your help and dedication.
Does this lawsuit and case help those who have been issued Green-cards, but are unable to travel to the USA due to border closures? My husband and I were winners of the DV2020 lottery – we managed to get to L.A on March 14th 2020, had our temporary I-551 in our Australian passports stamped, and then flew back home to Australia a day later.
Since then, our Permanent Resident Green Cards have been processed and posted. I have contacted our local embassy and they have said, if we don’t get over to the USA by March 14th 2021 (when our I-551 temporary visa expires) there are no leniencies in extending our visa. I wanted to know, does this lawsuit help our situation at all?
We have been applying for the DV lottery for 10 yrs, and it is devastating to think we are going to lose this. Any help is so appreciated.
