Hello there, I have a question:
I have sent my documents and got the confirmation email, Now I have renewed my passport although it had 2 years expiry left but due to a miss-spelling ( with my father’s name which i entered the correct one in ds-360 form), I had it renewd.
Also my case number became current.
Now my questions are :
1- Should I unlock ds260 form in order to change my passport info? If yes should i wait for another email asking for documents to send them?
2- Or Should i just tell KCC that my passport is changed with a copy of passport?
3- Or neither i just go to inerview with both of the passports?

Given you have changed, not just renewed the passport, you should unlock the DS260 and resend ALL your documents (old and new passports included).

Hallo Brit iam DV winner 2021 and in 2018 i was in the embassy and did not get a visa.I had submitted my parents name with 2 names instead of 3.In the DS 260 i submitted exact 2 names.Now that they will be asking for documents like my birth certificate which has 3 names of my parents will it bring any problem??if so what should i do.Kindly advise.

Well no, not everything is on track. The scheduling is blocked because of the ban, and many embassies are not operating normally due to COVID. However, that is the same situation everyone is in, not just your case – so be patient.

With Gods willing we want to fly together to the US. But I am a bit confused.. a friend told me not to attend the interview together.
What do you think? Is it best we attend the interview together or I go in first then later on my wife can go in?

You should both attend the interview. You should have one DS260 each. The DV lottery is the easiest and least expensive way to get a GC. Why would you opt for a more complicated process??

What do you think about it? I understand that these lawsuits are a gamble, but I am interested in your thoughts. When Curtis started his first dv20 lawsuit, you said it was a gamble worth trying, and you were kinda right. So… what do you think?
I understand that participation in this lawsuit will exclude people from relief for Kuck/Sisking lawsuit, if they get class certification, since one can be a plaintiff in one lawsuit only. Is this correct?

I am a DV2021 applicant with a very low case number, have submitted my DS260 and am currently waiting to be scheduled. What happens if I lose my passport before the interview? Should I request to unlock my DS260 and update my new passport number? Will this likely cause significant issues to my case? What is the best course of action/steps to rectify this? They don’t send the letter that says you are ready for interview based on your case number being current. They send it when you have submitted your DS260, and then sent your documents and once they have processed both of those things.

No. You are in the Schengen area, so you must go to some third country for at least 14 days prior to entering the USA. That rule is quite different to the ban due to expire on December 31.

About Azeri people who didn’t get visa for DV2020 and in general about DV2021.
I wrote to KCC. They denied the request to transfer it into Turkey because they said that Azeri citizens are proceed only in U.S. Embassy in Georgia.
I asked people who has DV2020 they said it was the same. Idk…

You keep saying “Azeri citizens” must process in Georgia. I keep saying it is based on where the applicant lives. Do you not understand the difference?
Now, if you at least understand that, the next point will be that KCC will vary their policy WHEN THEY ARE SCHEDULING INTERVIEWS. Not now, because they are telling you a theoretical policy. When it matters you will change at that point. Just be patient.

(1) Is it possible after I travel to the US, to adjust to study bachelor of architecture in one of the colleges there instead of diploma, and CONTINUE FROM WHERE I STOPPED my education in my homeland college?if that’s impossible, then how many years a person who is holding an architecture diploma should study in the us to obtain a bachelor degree & revoke the diploma?
(2) do you know anyone who works as an architect in the US while holding just diploma degree? This is because I want to make sure that a person with such degree has a chance to work.

Case number EU2xxx. I got a new passport today. In June, I filled ds260 using my old passport number and sent the picture of my old passport with other documents to KCC. I got the confirmation mail (“ready for scheduling”) in August. So now KCC don’t know my passport has changed, is that a problem? Hi Britsimon,
We are DV2020 winners from OC. We have our visa already in our passport and had it re-issued when our first visa expired. We re-did medicals and repaid the visa fee. Our re-issued visa expires on the 3rd Feb.
In order to leave Oz, we have to get an exemption to travel. You apply with paperwork to show your emigration intent etc. However, we have no job to go to as this fell through when we were initially relocating. And the current stats show that 75% of applications are denied.
Even if we do get this exemption to travel OUT of Oz, the wait list to get back INTO Oz is bordering on ridiculous and people are waiting for months to return on flights that are empty (due to CV restrictions etc) and incredibly costly. On our return we then have to hotel quarantine at our expense. So you’re looking at a cost of about $25K for return flights, hotel quarantine etc…
So my questions are…
1. Has anyone ever been reissued a visa twice? With your knowledge of the various court cases etc, do you think this is an option for us?
2. Do you think they’ll extend the validity of the medical for the second half of the year – thus allowing us to have an extra month on our visa validity?

1. No. You should certainly not bank on that. The lawyers are trying to get that setup – but it is not the primary focus.

I suggest you Plan to arrive by Feb 3 and find some way to make it work for a few months if needed.

My question is about the passport issue ..
I won the DV2021.
DS260 application was made in July 2020.
When I did the DS260 application, I didn’t have a valid passport.
I originally did not have a passport from my mother country from six years .
I own a Travel Document only from a country where I lived temporarily in a temporary residence status (for reasons as a refugee for several years).
This month, December, I received the renewal of the Travel Documents.
So What should I do?
Do I have to ask to open the DS260 application again in order to fill in the New Travel Document number? Or It is sufficient to send a copy of the Travel Document for documents in KCC.
Or what is the correct procedure?
Note, I was asked to send the papers from November, and I sent them all the papers, except for two passports, because they were not with me at that time?

But to clarify, I did not write in DS260 any number for any travel document .. even the old one, because it was expired. Rather, I mentioned that in the case of refugee I have the right to apply without a travel document or passport number.

Dear Simon, as always, thank you for everything you’re doing for the DV community. I am a EU DV2020 winner who was issued a visa on Sept 29. My visa is set to expire mid-february. Since I live in a schengen-ban country, I am now planning to travel to Aruba on jan 4th (giving me three days to see if there is a renewal of the immigrant ban, and most of my costs so far are fully refundable so it wouldn’t be an issue if that happens) which would allow me to travel into the US on Jan 19. One interesting thing about aruba is that they have immigration pre-clearance; you can go through US immigrations on the island itself. This means that I could theoretically book the cheapest ticket to the US (random destination), and attempt to pass through customs before my 2 weeks are up. If they let me through, I can cancel some of my trip, which would save me some money and two weeks of worrying about Trump passing some last-minute PPs. If not, I don’t have to be send back anywhere and I can sit out my 2 weeks on a tropical island (a real tragedy, as you can imagine 😉 ). However, I’m worried that trying to pass through immigrations might cause trouble, for example, if they open my envelope and then decide against stamping my visa. What do you think is the best course of action here?

I’m not really clear on what trouble you are imagining. You realize you must actually travel into the USA – right? YOu are not suggesting cancelling that part after going through pre-clearance, right?

From my understanding of the procedure, preclearance means that the immigration part is at the airport before boarding the plane to travel into the US. The plane would then arrive at a domestic airport/section of the airport in the US, which does not include border control facilities. They would “activate” the visa on the island side. I fully intend to travel into the US if they let me in, but while I’m not sure (i.e. before I’ve spend 14 days outside shengen), it would allow me to try for entry at that time with less monetary risk and time involvement than a flight from my home country, for example. Since some people have been able to get in despite the bans.

Well the important point here is that it is PRE-clearance. “PRE” what? Well in this case the PRE relates to the actual entry into the USA. The entry itself is important and the pre clearance only takes place for a plane load of people that are about to enter. So – in that case I don’t understand how you think that can be a benefit. But that’s OK – feel free to plan as you wish.

If the Anunciato case is certified as a class action and won, then this additional lawsuit will be largely unnecessary. I don’t see any particular strategy or advantage in what she is suggesting, but perhaps she has something worthwhile – I don’t know.
We *may* find ourselves in a position where individual cases need to be helped because embassies don’t schedule or move cases, but I don’t think that is what her lawsuit is designed to address – again – I don’t know. She hasn’t told me anything useful in that regard.
As far as NIEs for NIVs – well that has nothing to do with DV.

You should send an email to the KCC asking them to change interview location to the embassy you want and do not ask them to unlock your ds 160.
They will reply to you saying that your request has been done and interview location has been changed

The DS260 doesn’t need to be unlocked to change the interview location. Only KCC can change (or in fact, choose) the interview location. So – you can email them and ask them to change your interview location, but they will expect some justification for that, and may not necessarily agree.
Also – tread carefully. Asking for a change now makes sense if you think your interview will be scheduled soon, but if your number is high, it makes more sense to wait and evaluate the circumstances nearer the time.

I think if you have a high case number and your case will not be current in the Visa Bulletin even if you are a named plaintif, kcc and ambassy might not give you an interview appointment. Some dv2020 winners named plaintifs with high cases numbers got visas after Judge Metha’s decision because in all regions Visa Bulletin became current for dv2020. And with Anunciato lawsuit as a class Mr Brit Simon think that it’s not necessary to join any other lawsuit for now.

We have health private health insurance for me and my wife.
Question: When the baby is born, she will be eligible for public health insurance and/or other benefits since we don’t currently have any income. Will using/applying for these benefits affect our options to get a green card if our number becomes current?

I can’t answer specifics in a question like that, but if you have private health insurance the normal ting would be to add the child to your existing plan.

As I told you last time, things are falling apart in my marriage. We are going to divorce. But it’s going to take time! And we will surely be still married when KCC will ask for the documents.
My case number is AF35xxx, and KCC hasn’t asked for my documents yet.
Last time you advised me to let KCC or the embassy know that I will process on my own. I have a few questions regarding that.
1) Do I have to modify my DS260? I think there is a question regarding if your spouse is going to immigrate with you.
2) Do I wait for KCC to ask for my documents, send them all our documents (I already have all the documents regarding my spouse), and then let them know that I will proceed on my own after the 2NL?
3) Or do I send them an email before KCC requests the documents? If so, are they going to ask for my spouse’s documents considering that I cannot remove her DS260? My biggest fear is that KCC will be waiting for all the documents and then not consider my case complete. What do you advise me to do my dear Brit? Which is the best option?

1. Only once the divorce is legal. Until then you are still married.
2 or 3. Either way works – you don’t have to fear anything, because you can email/phone KCC and confirm they understand what you want to do.

EU50XXX doesn’t exist – but let’s pretend it did exist.
ANY lawsuit that unblocks the ban, or forces them to process all cases or whatever you want to imagine will not make any difference to that case UNLESS KCC make that case number current in the VB. Don’t forget, the government have full control of the VB numbers INCLUDING regression of the numbers which is “going backwards” in the numbers.

@Evil someone cannot seek justice by causing another injustice. It’s not because we have a high case number that we have to join a lawsuit to get our visa even if our visa number is not yet available on the VB. As long as our case is not current we have no RIGHT to get interview’s appointment. No judge can force the government to give us someone’s else visa.Lets just hope that your case will be current by september 2021.
