It is not compulsory to be on a lawsuit, but this year many people will not get their visas, so some join a lawsuit to improve their chance.

Hi Brit,
Does KCC ignore the interview location that is chosen in DS-260 form and schedules based on current address?
Based on my country of residence (Iran) Ankara was my default interview location, but at the time of filling DS-260 form I selected Abu Dhabi which is way more convenient for me to travel to.
Now that KCC is in such a mess and not replying emails or answering phone calls, how am I going to know where my interview location is going to be?

By the way, my documents were processed long time ago and recently I asked KCC if they are satisfied with my documents, part of their reply says: “Because your case is ready to be scheduled, KCC can no longer unlock your application.” which i already know what it implies through FAQ.

Yes they will base it on address, not what you choose on the DS260. You can try to get them to change that for good reason, but some embassies are openly stating they will only accept “local” cases.

Asking them to change your location may not work and could introduce some confusion – so changing again later adds more complication and risk. BUT there is risk now anyway – so make your decision.

Some bad news for #DV2020 Gomez (and consolidated cases – Mohammed, Fonjong, Kennedy, and Aker):
In status conference in Goh this morning, Judge Mehta expressed need for hearing for Gomez/DV2020 and proposed to Goh attorney Charles Kuck that it be concurrent with #DV2021 hearing. Kuck did not argue it should come sooner.
This is indication that an order for DV2020 will probably not be forthcoming in May or June.

Hi Brit – I remember you replied to a questions a few weeks ago that if someone arrives in US with H1 or L1 in July, it is tight timeline to apply for AOS but it is still possible. I was reading someone’s mom and it says you have to be physically present in US at the time of confirming your DV selection, then I hear from others that you must be 3 months in the US before you can apply for AOS. Can you elaborate more please? Thanks.

Mom is technically accurate, but there have been cases where people have switched after moving to the USA and not experienced the problem that Mom refers to. That is particularly true on H1 or L1 cases.
But at this time there is risk either way – you have to decide what produces the least risk.

It feels like DV system is not valid anymore. It only gives the “winners” a low priority place in govt backlog of cases. And few of these winners are picked randomly by KCC and processed for a visa. Covid has been a good excuse until now, but do you think it will be any different in the near future? Maybe DV2022 winners’ page should come with a caution not to expect much…

I have a situation: a case number 2021EU4** with documents ready to be scheduled since september 09 2020. Several times I have got response from KCC that I am current now for scheduling on my requests starting from March 2021. However, on 4th of May about 20 cases from my country with higher numbers up to 65** received their 2NLs even though their documents were checked later than mine.
How does it works? KCC is not responding to my last 3 letters starting from 22nd of April. What actions should I take? Is it the only way to join the lawsuit with a case smaller than 500 ?

If you want to have any chance at all, you will send in your documents. BUT it might already be too late, and KCC don’t appear to be working on processing cases.

Asked more people, it seems they can’t issue visas no matter what. They say that people in Washington don’t allow to do that.
If you see the ceac table there are lot ‘Ready’ but no ‘issued’
It is not problem on my case, it is whole Europe problem. What you think about that? Why they can’t issue visas even after successful interview?

I was told they have technical problems. Nothing to do with Schengen because some OC and AS are also affected. I was reading the fingerprint system is somehow involved.

Hi Brit!
I have served mandatory military service in Belarus, but moved to Canada since then (and became a citizen of Canada). Unfortunately, I don’t have any military records, and Belarus embassy said the only way to get them is to physically go to Belarus to request them, which is hard to do during Covid.
I am about to send my documents. I was wondering if you know whether not having the military record can be a problem? Or if you have any other advice.

Sounds like you have no choice but to send the documents without military records. Yes that could be a problem in normal times, but you have probably left the sending of documents too late anyway, and in general it seems KCC are not processing or scheduling many cases. As if all that were not already bad enough, Montreal haven’t accepted any interviews yet.

I filled out 260 forms on 4/15/2021 and then kcc asked me in Date: 4/20/2021 for further documents and I sent the needed supportive documents Date: 04/24/2021 but until now my case is at “NVC”. My case number is a low case number which is 2021AF00011xxx . I am so worried b/s the June interview case number is ready until Case N0. 2021AF00018000 mine is lower than this case number.
1. do i have a possibility kcc send to me 2NL science my case is very low case and below the June interview ready cases which is below 18000
2.what should i do next? do i ask to kcc for is my document satisfied or i wait
3. in my country ethiopia the quota in normal circumstance is more that 3700 but till now only 7 interview and no ethiopian case ready in may and june does kcc separately send 2NL to which a country like ethiopia no cases ready for interview

1) 2020/08/30 I submitted my DS 260 application
2) 2021/03/02 I got married
3) 2021/03/02 I unlocked my DS 260 form to add my wife.
4) 2021/03/02 submitted DS-260 form again.
I tried to contact KCC twice last month (2021/04/21 & 2021/04/30) regarding the Current updates about my case but they didn’t reply to me yet.
I hope the @BritSimon have some advice for me.

Every case is at risk. You can try and move your case if you feel that gives you the best chance, but there are no guarantees.

They says: There is a data error on computer and support team in Washington DC is tryna deal with this issue now. So now they can’t issue visa and after this problem solved they start to issue my visa..

My case number is 2021AF18*** and I became current over 3months ago.
I have sent my Ds 260 last year June, I sent my documents 20 March 2021 but I forgot to add a written explanation on my two passport bio page one representing the old passport I used to enter the lottery which is expiring on 15 May 2021 and the renewed passport which will expire 2030 together with my Police clearance certificate and my Birth certificate, thus I got an email from KCC titled “FURTHER DV DOCUMENTS REQUIRED” on 22-March-2021.
So on 23-March-2021, I sent all the documents back to them with a written explanation concerning the two passports bio-page.
On 23 April 2021, I sent them an email inquiring on their satisfaction with my sent documents.
I just received an email from KCC with this information ” Thank you for your inquiry.
Your DS-260 has been processed. You should have received, or will soon receive, an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing. You’re from Albania, right? Well, your embassy is taking cases. So being in the lawsuit could help you. However I need you to understand that it is a risk you must decide. Personally I was really thinking of signing up for the other lawsuit back in January. But I took my chances and eventually got my 2NL. If you sign up it could help you. But if you would have gotten the interview anyways then, you could be wasting money. It really is your choice man.

I got that same Email and when i asked BritSimon, he told me that, when you receive that mail it means KCC are “actively processing the case for Scheduling your appointment and Interview Date”, therefore KCC cannot make any further adjustments to your case.
Now you will have to go for your DV Appointment according to WHERE YOU FILLED IN YOUR DS260.
So Just wait for the Notification Email from KCC with your Name and it says:-
You have received this email notification to inform you that you have updates available at https://www.dvprogram.state.gov/ESC . Please log in using your confirmation number from your original application to complete further processing.

Montreal is the only interview location for Canada. Up to now they have not accepted even one interview. So – KCC obviously want to schedule your interview, but Montreal may not accept DV cases.

If Mehta decides that visa processing can go ahead, there will likely be fewer visas available than people. In that case, you should not do anything to delay your case, IF you get a chance to process. So – you can discuss how to add your spouse, but if needed take the visa for yourself and plan to sponsor your wife once you get to the USA. It will take about 2 years.

I did receive an automated email from kcc as they have been taken my documents for processing but it has been too long for a reply as of what happened with the documentation and further processing. all i receive back is an automated email and i have been trying for their hotline and what should i do? should i contact the US embassy in sri lanka or directly to the hotline? let me know please.

You can ask KCC if they are satisfied with your documents. That may help, but KCC have not been very cooperative recently.

In DS260 I submit Bachelor degree as highest level of education. Do I have to bring also and High school diploma too? Is it necessary to have it besides Bachelor diploma? Sometimes the COs want to see HS documentation. So – you can try without, but it may cause a delay.

Hello Brit, AF32K here and I sent my docs in March. I did a follow-up late last month whether they were satisfied and below is the response I received yesterday. What’s your thought however on that please?
“Thank you for your inquiry.
Your forms have been received and are currently processing. Allow several weeks for processing. Interviews are scheduled numerically based on case numbers that have completed processing. Once the Kentucky Consular Center has finished processing your DS-260, you will receive an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing.
After sending documents to [email protected], you will receive an automatic reply to your email. If there are no attachments, the auto reply explains there are no documents attached to the email. If there are attachments, the auto reply explains we received your email and are currently processing your documents. Please allow time for processing of your documents. Documents are processed in numerical order, based on lottery rank number. Once KCC has processed your documents, we will let you know if anything is missing or if we have received everything needed.
In order for the Kentucky Consular Center to assist with inquiries regarding a specific Diversity Visa (DV) case, you must provide the Principal Applicant’s full name, complete case number, and date of birth in the following format (MMDDYYYY) as entered on the original entry. Please remember that the Kentucky Consular Center does not have the authority to tell you whether or not your specific case will be disqualified. Only a consular officer can do that at the time of your visa interview. Do not send any paper documents to the Kentucky Consular Center.”

The draw was done long ago. Since then some cases have already been removed based on various checks, and now tomorrow we will see a simple publishing of the winners.

I sent my documents 5 times now without any response from kcc, and they’re keeping telling me that my form ds260 has been processed and nothing about the documents I submitted since August for the first time and April for the fifth time.
The police certificate of my current country of residence got 12 months old this month of may 2021.
Should I renew the police certificate and resend again the documents or it’s not necessary ? Thank you

I would renew the police cert in case you get an interview, but I would not resend it to KCC.
However, you have submitted 5 times. If you have a low case number, that might indicate that you are doing something wrong, because they should have processed. On the other hand if your case number is high, it might simply indicate they never got to your case for document processing.

Hi Brit . I sent my documents long time ago but i didn’t receive any confirmation from KCC . So i sent them an email asking if they are satisfed with my documents and they answerd me with this email down bellow : ( My questions is should i consider this reply as a confirmation that my status is good ??even if i didn’t receive an usuel confirmation ) .

Interviews are scheduled numerically based on case numbers that have completed processing. Please refer to the visa bulletin at https://travel.state.gov to locate the current numbers being processed. This bulletin is updated after the 15th day of each month. Once an interview date has been scheduled, you will receive notification via email to check dvprogram.state.gov.

Hey Brit, DV21 here, with 28K AF, i got the documents email in late august from the last year & sent my documents, in October i open the ds260 form to add my new passport and i sent both version (OLD& NEW) to KCC with a letter explination and all the Required Documents again, but since then i didn’t get any confirmation,I decided to send all the documents again in March this year, (i got new one such birth certificate and police certificate beause they expire in my country about 3 month), I sent an email to KCC to ask about my documents, and they answered me with an auto replay: “You should have received, or will soon receive, an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing.”,
what should i do Brit? thank you so much for your help!
