Hi Brit. One question for you… After approval, I intend to go alone first in april, with my spouse and two children (derivates) following me after the end of the school year sometime in summer. When my family finally arrive in to the US, do I need to go through the custom and immigration with them as a main applicant or can they do it without me since I will be in the states already?
I am asking because our final destination in states have no international airport (only domestic flights) so we must have one stop first (probably Chicago) where we will go trough custom and immigration, so I need to know must I be present with them in Chicago, or can I wait for them at the final destination?

Your case number is very high, and probably should not have a chance if everything was working properly, however, no one knows what will happen and things can be changed by some embassies behaving badly (as they are). So – wait and see.

Hi Brit Simon, I’m call Asong lambert base in Bahrain, I won family lottery in this present year 2023. And my embassy I choose for my interview was Bahrain because I live and work in Bahrain but my wife was living and working in my home country cameroon. I have been living in Bahrain for the past 5 years without my wife but I went visited once, that’s on 2021, and my wife came to Bahrain jst last month prior to the interview, So on the 16 February 2023, I went for the interview with my wife, the consular officer ask me “ Further evidence of relationship between my spouse and myself, which is some pass texts messages we have shared before. That I should come and drop at embassy that she will get back to me, And I have done so already. my question is would the embassy actually get back to me after reviewing the text messages, if yes how long can they take to get back to me or ist a polite way of refusing me the visa?? Pls excuse my curiosity sir.

They are still backlogged, but they do seem to be trying to improve – they just took 198 interviews for April.

Hi, I activated my LPR in the end of July 2022, but I only stayed for 10 days and I came back to France. I will move to the US soon.
1. I had no income in the US in 2022, only in France. Do I must file tax return for 2022 ? And the report of foreign bank accounts ?
2. I didn’t change my address in the USCIS website since my first entry so it is still my friend’s address where he received my GC. You said we need to inform USCIS for any change, but does it mean only for US address ? Should I change it only when I will move definitely in the US ?

Hi Brit, I’m call Asong lambert base in Bahrain, I won this year lottery 2023 Family status. My appointment was on the 16th February a couple of days ago, I have been living and working in Bahrain since 2018, while my wife works and live in my home country cameroon. And we have been married since 2017. So in the past 5 years I went and visited my wife just once. And she came to Bahrain last month prior to the interview. So at the interview which was on the 16th the consular ask me to bering “ further evidence of relationship between spouse “ which are some past text messages, which I have gone and drop at the embassy on the 19th my question now is, would they actually get back to me after going through my evidence or it’s just a polite way of refusing me the visa?? And I won this lottery with my wife I didn’t not add her after winning. That’s why I’m a little worried, pls if you can clerify me I’ll be more than happy. Regards..

Nairobi are very backlogged, so many cases will probably lose their chances unless the embassy changes its behavior immediately. If you can move to another country – do so.

I reopened the ds 260 and added my newborn.since it takes months to receive a passport for the newborn I used my wife’s passport number for the newborn since she is the principal selectee.hopefully we will get my newborn’s passport on time or make the necessary changes at the embassy.just praying our case gets processed on time.Thanks for the advice to reopen and add the newborn.our ds 260 had not been processed anyways.I was worried our case would be send to the back of the line but I realize reopening was the best thing to do

I do understand that I need to enter the States before the visa expires (6 month or so), but can I return back to my home country let’s say a week later to take care of things before I permanently move over? I have a trusted friend at the address in the US where my green card will be delivered, and she will take it over for me. I plan to return a couple of months later to the US and pick up my green card from my friend. On travel.state.gov they say “Do not travel outside of the United States until you receive your Permanent Resident Card.” Is this more like a recommendation only, to make sure the green card lands in good hands when delivered? Or do I really have to stay until the green card gets issued and delivered?

Once the interview date has been scheduled, you will receive notification via email to check https://dvprogram.state.gov. If you need to make changes to your DS-260 you should contact the consular section where you will be interviewed, or bring the information about your changes to your interview appointment. Because your case is ready to be scheduled, KCC can no longer unlock your application. Our son’s add was successful and a confirmation number received but my wife and I couldn’t update our ds 260.Anything to worry about?

My point earlier was that you should have printed out the memo and been prepared to show it because I know, as in uyour case, the COs are not generally well informed about how CSPA works in DV cases. So – print it out!
As for chances – you are entitled to the CSPA protection. It is not a matter of a choice for the CO.

Hello Brit. AFDv23 selectee, I am scheduled for interview already. I emailed Yaounde consular unit requesting an unlock of my ds 260 for some revisions. This is what I got from them as a response “In order to rectify any mistakes, you will need to complete a new DS-260. Print it out and bring it in with you when you come for your interview. We will then be able to correct the information in our system”. What does it mean?

It means exactly what they said. If your mistakes are minor, I would not suggest you spend the time doing that. If your mistakes are significant, then you should have unlocked earlier.

Hey Brit, DV2023 winner here, Eritrean national born in Saudi Arabia and living in Ethiopia. My case number is 2023AS18**. I submitted my DS-260 late August 2022. When should I expect my interview? Also I made a very minor mistake. I mistakenly filled a phone number I used to have in Eritrea. Do you think I should ask the KCC to unlock my DS-260? Patiently waiting for your reply. No need to unlock for the phone number.
Addis though is restricting the number of interviews it accepts each month, so your chance depends on when your case moved to AV status (where you get an email that says “current for interview processing”.

Greetings Simon, My wife won Dv lottery 2023 AF16K and got interview for April 18. Two of our kids and herself are attending their interviews in Ethiopia. Unfortunately, I live in the US and I have an Asylum case so I won’t be joining them for the interview.
Couple of questions, would I be able to have my Interview here in US, if yes, what should I do? Me being absent for interview, would it have any effect on their chances of getting success?

Your absence won’t affect them. However, your path to GC will be a bit long winded. Assuming you were NEVER out of status, you will be able to adjust status once your wife has entered the USA. You should discuss that with a competent lawyer.

– DS260 sent on May 11
– Embassy changed via KCC from Warsaw to Yerevan on Dec 12
– No unlocks
– Case status (from KCC) “current for interview processing” (no 2NL yet)
#Prerequisites:
– I am not hysterical, but has some reasons to be impatient since my family is under a continuous risk due to the war in my country
– I watched all your videos/read all the articles trying to understand sequence of 2NL sending
– I also analyze the CEAC data, and, for instance, in FEB plenty of cases with higher number got their 2NLs
#Questions please:
1) Does the embassy change anyhow affect my place in line for 2NL sending?
(I believe, the general answer is “yes”, here we have question #2 please :))
2) Do I understand correctly, that:
(a) my case was probably put into an “embassy-s current for interview processing” queue
(b) this particular line has “first in – first out” approach, and since I was assigned to the embassy only in Dec (please see “Initial data” above), probably some higher cases got their place in line earlier than mine

Yes. Each embassy has it’s own distinct AV queue of cases. Your case is added to the AV queue when your ds260 is processed AND your case number becomes current. The order in which you enter the AV queue is preserved, meaning a case with a lower number than yours that completed DS260 processing later than you would be behind you in the queue.
Yerevan is doing pretty well so far. They just accepted 198 interviews for April – so based on what you have said you may wait a month or two more before scheduling, but I think you’ll be OK.

Hi, Af 19k, submitted ds260 on 1st Nov and reopened on 28th Dec to make a correction. I emailed kcc on 22/02/23 and got feedback that my ds260 had been processed but i have not yet received a 2nl. My interview location is the Bridgetown embassy , Barbados which has only one person in ready status for dv interview so far since October.
1.Does it mean there is no queue at the embassy?
2. When should I expect a 2nl for me and my derivatives
3. Why does my visa status in ceac still mark ; at NVC

I moved to another country this month, I was trying to contact US embassy since first week of Feb to transfer my interview location but no answer! What should I do? 1. I hope you are doing this right. Read this link – https://britsimonsays.com/how-to-change-embassies/
2. You can do that by delaying your first trip (entering before the expiry), and then stay there long enough (some weeks) to apply for a re-entry permit, OR leave for up to 12 months, return, leave again and return within 6 months. Repeat if needed. The expiry date will be based on your medical date plus 6 months, so do that late.

The first means processed.
The second means you have been added to the AV queue for the embassy. Depending on the status of the embassy you may get an interview soon, or you might wait.

Your DV case is risky because of your case number and country of Iran. However, by filing the DS260 you have already caused the concern about wanting to emigrate. So – you cannot simply cancel the DV case. You have basically created a mess, and I don’t have a solution.

You can’t unsubmit the DS260 once filed. You can not continue with the process, but the fact that you submitted the DS260 (thus showing intention to immigrate) cannot be undone.

Dear Simon, I hope you’re doing great.
I’m Kamal with cn AF43k. I spoke to you around 2 weeks ago when you posted videos about embassy backlog and heavily told people to change from Nairobi Embassy to another good performing embassy if they can.
The last time we spoke, I found out that I have already reached Nairobi Embassy AVQ after emailing KCC and got the response ‘Your case number is now current for interview processing. ……………. KCC can no longer unlock your application.’
With that, I asked you here on what I can do moving forward and whether changing from Nairobi to Kigali is possible.
You told me ‘NO, its not possible to do it via KCC.’ That I will have to just request for a transfer when I get 2nl.
A friend of mine with cn AF47K did change his embassy from Nairobi to Daresalam Tanzania 3 weeks ago. And he got his 2nl tonight. So that is a big factor for my motivation to change my embassy to Kigali
I’m getting really WORRIED and UNSETTLED by how Nairobi embassy is behaving and pressure is just piling up.
1. Are you hopeful Nairobi can do any better as months move? Can we justify with the fact that they sent 1600+ 2nls in the last 4 months of DV2022.
2. How do I grow up my patience?

1. I am worried about Nairobi. Even if they do a good number in the last few months they could have caused damage by then. If you can get another embassy to accept you, that is the only way out of the AV queue.

I will do everything to save my case and get out of the AV queue for Nairobi Embassy.
But here’s my concerns on getting another embassy to accept my case.
I have read your article https://britsimonsays.com/how-to-change-embassies/ on how to change/transfer embassies.
On there, you say a transfer can only be initiated if one has already received a 2nl, but CANNOT attend his interview in his designated embassy. So he contacts the embassy in his new country and checks to see if they can accept his case.
But now I don’t have a 2nl, but highly want to get out of Nairobi’s AVQ. Here are my questions;
1. Can I still message Kigali embassy(where I want to transfer to) and check to see if they can accept my case.
2. You have also been saying that when someone is in AVQ, his designated embassy doesn’t know about his case because the case hasn’t yet reached the embassy. For example, my case hasn’t yet reached Nairobi embassy meaning they don’t know about me. So with that said, can I also still message them to tell them to transfer my case to Kigali.
3. And if the transferring option needs me to first have received my 2nl. Why in the World would I want to transfer my case and make the process harder & longer for myself if I have received 2nl from Nairobi and can attend interview there . It just doesn’t make sense.
If you know of the exact steps I can follow to get out of Nairobi’s AVQ and transfer case to Kigali without a 2nl, kindly let me know please
4. How do I transfer to Kigali when I’m Nairobi’s AVQ without 2nl?

1. Yes – that is your only chance. If you are local to them and have good reason to get them to accept your case, they might email KCC on your behalf asking for your case to be allocated to them.
2. Again, Nairobi have no knowledge of your case until the 2NL is sent. So discussing your case with them is pointless.
3. You wouldn’t. That is the catch 22.
4. see 1. It is not a guaranteed solution. It is more likely to work if Kigali are convinced you are local or have strong ties with Kigali

So the solution for now is to email Kigali requesting them to accept my case because I will be in Rwanda Kigali for more than 1 year for my studies. And when everything goes well, it will be them to request KCC to allocate my case to them.
1. That’s what I understood from your comment. I hope I’m right, Simon.
2. The reason I will tell Kigali is “I’m going to be in Rwanda for studies for over a year, so kindly accept my case.” And I will make sure to get a Rwandan Student Visa on my passport to prove residence.
So is this a good reason that can convince Kigali to accept my case?
And btw, I’m local to Nairobi and not to Kigali.

I applied before for US visit visa (business trip) in 2005 through my employer, my application was rejected (reason was that I did not show that I have strong social and financial ties with the place of my residence. I am Sudanese but working in Saudi Arabia), at that time I filled my birthdate as 07/10/1982 (my actual birthdate), back in the day our passports had only birth year (no month and day), my first passport when updated (month/date) was 01/01/1982, I did not bother to correct it, because it did causes me any trouble here! I am DV 2023 winner, and I have an interview scheduled next month, do you think this discrepancy will cause me future problem, during interview or when entering US?

I won the lottery in 2021 and in 2022 I finally got approved with the visa issued on my passport. I had until November 2022 to enter into us to activate my green card and, in fact, in July 2022 I entered into the US for a week and then I moved back to my home country.
In the meanwhile, at the end of 2022 I received the email from USCIS that my green card was physically delivered at the address I provided as my permanent address.
Now, next week I am going to US for another week to make some interviews and take possession of my green card. However, apart from the visa on my passport (which states “expiry date November 2022” but it has also, on the very next page, the stamp that I have entered in July 2022 as DV1), I have no other evidence that I can “enter” legally in the US.
Do you suggest applying for an ESTA too or should I be fine with my passport?

Your passport/visa has the notation that means it serves as your temporary greencard, so you use that. The airline should understand. NO ESTA.

I am in a similar situation. EU34XXX and I submitted my DS-260 back in May. Now I have been accepted to a Master’s course in the US with a scholarship and I am worried that I might not get a DV interview AND have my F-1 rejected due to having filled out the DS-260 and shown immigrant intent.

The DV DS260 application creates a risk for non immigrant visas. That damage is done. The decision is made case by case, but the DV application makes refusal more likely.

I’m Ephrem Chekole. I was selected for DV 2023. Unfortunately, I made a mistake in the eDV entry form. Let me explain my mistake. When I submit the eDV entry form I said I’m married since I’m. But I didn’t give any information about my wife rather I duplicate my personal information instead of her personal information. So, they have no real information about my wife. Since what I submitted about my wife’s personal information was perfectly the same as my personal information(Name, Birth date, photo…..). Dear Mr. Simon,
Me and my wife activated our LPR in Oct 2022 and returned back to Morocco after 3 days. Our green cards arrived at house of our friend after one month and cards are still with them.
I was about to travel alone on 21st Feb 2022 on Air Canada fight to New York via Montreal and my wife had plans to follow me after a couple of weeks. One surprising incident happened at Casablanca airport (CMN) that the airline staff refused me boarding stating that my US IV has expired. The counter clerk and the supervisor were concentrating their whole attention only on the dates ‘Visa issue – 6th July 2022’ and ‘Visa Expires – 23rd Dec. 2022’ on the visa sticker. They were not interested on the notation “Upon endorsement serves as temporary I-551 evidencing permanent residence for 1 year” and “the Customs and Border Protection admission stamp” on our first visit to USA in Oct. 2022 at Boston airport. I tried to explain to them that the expiry date is ok but it doesn’t apply to me as I had already entered US before on this visa and this visa s endorsed and serve as temporary permanent residence until we receive our green cards. I also try to how them photo of my green card but they did not entertain me and said if it is so then I should show my original green card and they were not going to check me in and board the plane on the basis of that visa. I asked them to give me some proof that they have refused me boarding on the this basis but they didn’t gave me anything but when I insisted the lady supervisor took photo of their monitor screen and showed me where I noticed like ‘Expired visa’ which they have entered into their system. I returned home back and made a formal complain to Air Canada where they replied it will take 45 days for resolve the issue. I also wrote to to US Embassy Rabat Morocco and their auto reply it is mentioned that if the answer for such question is available on the website then they are not going to reply. Upon further search I found https://trip.dhs.gov/s/ website where I lodged another complain for denied boarding option.
I would like to request your opinion,
1. If I can book from other airline or
2. Should I for wait for some reply from TRIP DHA or US Embassy or Air Canada so that I can take support of that to travel to US or
3. Should the green cards be mailed to Morocco?

The airline screwed up. You can decide what to do next, but obviously having the GCs in hand will make things easier.

My husband and I passed the interview successfully at the French Embassy which finished by a nice ‘welcome to America’ by the agent! We are now waiting for our passeports to be back to be able to fly to the US!
First, we would like to thank you for creating such a great source of advices & information via your website & videos, it helped us a lot :).
We have been contacted by the Embassy around 10 days after our interiew, asking for our mariage certificate + the birth certificate of my husband. We do not really understand why they are asking these documents after the interview and after saying that the green card is approved. What is also not logical to us is why they did not ask for these documents when we were in person at the Embassy. (we had all the documents with us)
Do you think it will cause a delay in getting our passports back?

Yes I think it cause some delay. The visa isn’t guaranteed until it is in your hand, so despite what the CO said, you must provide what they ask and wait for the outcome.

You cannot add a spouse until you are actually married. When you get married (which you should have done earlier) you should immediately unlock and add the spouse. You have listened to bad advice about unlocking – it is not bad as some misinformed people have said. BUT it would have been better to marry earlier and added the spouse earlier.

So at the time when you entered the DV lottery you claimed to be divorced when in fact you were still legally married. If that is correct, then you cannot possibly get your visa, you will be disqualified. You cannot fix this as you cannot show divorce paperwork dated before the entry. You would be better off not proceeding.

It is the point when you are processed, and your number is current. You are now allocated to the queue for the embassy. The queue may be short or long, depending on the embassy and their capacity.

Your DS260 should have the accurate version of your name that matches your passport (and birth cert). If it doesn’t, you must unlock and correct it.

I would like to ask for advice, as a DV 2023 selectee.
I have an EU case number which is already current 80xx.
My life circumstances didn’t allow me to relocate, a contract was holding me here, now it have changed dramatically, for the better, so I have to make a decision, but I need some info for that, hoping that you can help me out.
I have completed the DS260 form, but haven’t submitted yet. ( As I read on your FAQ portal it might be a little more risky, than early submission, but not impossible, so why not give it a try)
The reason:
I would like to know, if having a visa stamp gives me any sort of obligation towards the US?
I have read on the IRS portal that once I become permanent resident, I must pay tax, and luckily I am having cool pay offs this year, in april, however having a double tax on it, that would be not so good. (There is no tax treaty valid for my country unfortunately – Hungary)
So the question here basically is that, if I have a wonderful interview (therefore I am getting the visa stamp), does that make me pay tax? ( As the rule says Its worldwide income that must give the base of the tax ) – Or from which point of the process I become a permanent resident.
Or maybe is it the physical presence in the US, getting SSN etc… that initiates the IRS processes. ( and once it does, is it for the full year )
Can you please help me understand that?

You are considering life impacting decisions based on a little bit of tax. That seems short sighted to say the least.
I am not a tax expert and you may find your foreign income is below the foreign earned income exclusion. However, your tax obligation start in the year you become an LPR. So if you had your interview After from July onwards you would be able to defer your first entry until Nauray, then you would not file a report for 2023 at all. Your first tax report would be for 2024, and due in April 2025.

Hi Brit I am one of selected Dv 2023 from Afghanistan and as you know the embassy of us closed in Kabul I selected my interview location in Tashken Uzbekistan. my case is current on February but still I didn’t receive my 2NL I ask KCC about my Ds260 state they send me this email Your case number is now current for interview processing. Once the interview date has been scheduled, you will receive notification via email to check https://dvprogram.state.gov do you think Tashkent is good for interview or I have to change my interview location to Islamabad Pakistan. when I check ceac data Tashkent didn’t take any cases from Asia up to now.

Well you have left this decision until too late. It is not easy to change once you are in AV status in a queue for an embassy. So you have made your choice.

Dear Simon, my interview is scheduled in April. 😀 When I look at the pre-interview checklist for my consulate, it doesn’t mention to come with the High School diploma to prove my qualification to the DV Program. Is it normal ?

You should take what you think you will need. The checklist is the bare minimum of documents, not everything. They don’t know how you will qualify, how you will meet financial requirements and so on, so they don’t list what will be needed in your specific case.

Hi Simon, I hope you are you well! i wanted to ask a question that i have that i cannot find the answer to. I was born in a country in Africa eligible for the DV lottery, i left my country ob birth at the age of 12 for the UK. I no longer have a passport for my country of birth since i never returned but have a UK one. If i am successful, big IF for the DV2024 which passport am i required to use? The one from my country of birth or will my now UK one suffice?
